These are the Terms and Conditions for MyGrievance.co.uk, which govern your use of the web site and which you must read and accept before becoming a member, along with the Privacy Policy. If you do not agree to be bound by these terms, you may not use the web site.

This agreement may be modified by the operator at any time without notice; your continued use indicates your acceptance of any amended Terms and Conditions.

Service Operator

The web site is operated by Humane Resources Ltd, a company registered in England and Wales no 04450702.

Service Description,Warranty & indemnity

MyGrievance is an online information and networking service for individuals and groups concerned with unfair treatment at work, eg bullying, discrimination, harassment etc, and repercussions of the same, eg stress, illness, litigation etc.

The service is provided free of charge and as such it is not a “regulated claims management service” pursuant to the Compensation Act 2006. Accordingly the operator’s complaints procedure for clients of regulated claims management services does not apply to members of and visitors to this web site.

All information on this web site is published free of charge and without warranty of any kind. Nothing published on this web site constitutes professional advice. Visitors’ and members’ reliance on any information published on this web site is entirely at their discretion and responsibility.

Visitors and member agree to indemnify and hold harmless the operator and publisher(s) from any claims for damages said to arise from information published on this web site. Service may become unavailable to some or all users without prior notice because of technical, commercial or other reasons. The operator is not required to give notice or reason for unavailability of the service.

Eligibility for Membership

Members must be at least 16 years of age. A member may only have one active account. Members who have previously had their accounts terminated may not re-register.

Your details

You do not need to disclose sensitive personal information in order to register as a member. Your password cannot be read by the operator. The operator recommends that you do not use your real name as your login name (username), and that if you use the forum you refrain from posting information that would identify you or your employer to visitors to the web site. You are responsible for all activities that occur under your password or account and should therefore protect them. Do not disclose them to others, and notify the operator immediately if you believe another person is using your account details. The operator will not be liable for any loss or damage arising from section. In view of this the operator cannot the identity of any other users with whom you may interact through the service, and cannot guarantee the authenticity of data which other users may provide.

The web site may conduct surveys. In order to validate the responses to surveys, members who wish to take part ARE required to give a verifiable real name and address. The operator will not disclose this information to any third party, nor will it be used for any reason that the member would not want. The sole purpose of a member providing the information is so the operator can validate and certify survey results, and be sure there have not been multiple entries from the same person under different identities.

Termination

You agree that the operator may at its sole discretion to terminate a member’s use of the service without giving a reason and without liability to you or any third party. Without limiting the foregoing, the following will lead to a termination by of a member’s use of the Service

  1. breaches or violations of these terms Terms or other agreements or guidelines,
  2. requests by law enforcement or other government agencies,
  3. if you request termination of your account;
  4. unexpected technical or security issues, and
  5. extended periods of inactivity.

 

User Conduct

You understand and agree not to use this service to:

  1. Post content or communications that are unlawful, defamatory, abusive, obscene, discriminatory or otherwise objectionable;
  2. Use the service for any illegal purpose;
  3. Imply that you are or claim to be an actual person other than yourself;
  4. Publish by any means available to you:
    1. information which you do not have legitimate legal rights to publish, including infringements of patents, trademarks, trade secrets, copyrights or other proprietary rights.
    2. unauthorized advertising, promotional materials, spam, chain letters and so on.
    3. software viruses or programs designed to interfere with operation of software, hardware or telecommunications equipment.
    4. material that stalks, harasses, intimidates or bullies anyone.
  5. Monitor, copy or present content on the MyGrievance.co.uk web site in another form without the express prior written consent of the contributor and operator.
  6. Do anything that places an unreasonable load on our infrastructure, including but not limited to unsolicited communications or attempts to gain unauthorized access.

Forum and Groups

MyGrievance.co.uk exists for people affected by workplace bullying, and the web site focus is on how to recognise and address bullying and how to navigate what can follow a complaint of bullying. Members are invited to contribute questions and answers to the forum and thus benefit from mutual support. While bullying is abjectly unjust and causes indignation, this web site is meant to explore resolutions that do not involve revenge, or "naming and shaming".

The nature of the internet is such that measures are needed to keep the forum and group facilities as safe and enjoyable as possible for members. There is no guarantee that the site will be free from abuse, so these guidelines exist to show the minimum standard of conduct that is expected of members.  Continued use of the web site will be retained by those who are courteous and considerate to other users. Persistent or serious non-compliance with these guidelines may result in temporary or permanent banning from the site

In particular:-

Respect:

  1. Do not use the forum to deliver personal attacks, insults, threats, provocation, obscene language or libellous material. Posts must comply with these Terms of Service and statute, for example s.127 of the Communications Act 2003 (UK). Any member attempting to create cliques / splits / factions will be removed. If you must mention anything connected with any religion (including atheism) or politics, please bear in mind that this is a multi faith, multi cultural group and be sensitive to the fact that someone else will feel inclined to disagree. For the purposes of this forum, please regard your religious and political beliefs as subjective, and yet keep your references to them objective. Please protect the web site operator and yourself from potential libel suits by witholding the identities of alleged wrongdoers.

Trolls:

  1. Sometimes bullies pose as victims and use forums like this one to incite arguments. If you feel incensed by a message, do not respond to it, but report it to the forum owner, who will deal with it accordingly. Relevance:

  1. Use appropriate topic headings. Please find and use an appropriate sub-forum for your message. If one does not exist, please create a new one. By all means bond with other members, but please do not use the forum to convey messages that are only relevant to one person; try and focus your contributions on the relevant topic rather than an individual reader.

Identity:

  1. There is no requirement to reveal your true identity to other members. However, if you have joined the forum in a professional capacity, please indicate this in your signature, eg by stating your job title. Please do not identify any person or organisation with which you may be in dispute. Do not write anything that you do not think would stand up under public scrutiny.

Copyright:

  1. If, in relation to an article, you are not the original author or you do not have the author’s explicit permission, do not cut and paste material onto this forum, and do not copy material from this forum to anywhere else. The original authors own the copyright to all articles on this forum, including images. If you find potentially useful article on the Internet, please do not reproduce it in full, but post a short summary or introduction followed by the URL. (An author’s use of the forum is deemed to implicitly grant permission to display the material on the forum.)

Advertising:

  1. Use of the forum is free. Please do not use it to publicise commercial products, services, discussion groups etc unless they are (a) of direct relevance to workplace bullying and (b) you have first obtained the site operator's agreement.

Moderating:

  1. Members are treated as adults and are expected to moderate their own contributions. The list owner and moderators reserve the right to filter messages, or suspend or terminate the membership of anyone who persists at breaking these guidelines.

International Use

This is a UK based service aimed at UK based subscribers. Visitors and members from other countries are welcome. Your use of the service confirms you commitment to comply with all applicable laws regarding data transmission in the United Kingdom and the country in which you reside.

Your Content

Users may provide content on profile pages and as forum posts, articles, images etc. You understand that by content on the MyGrievance.co.uk website or otherwise providing information (other than sensitive personal information) to the operator, you grant the operator a royalty-free license to use the information in the course of offering the service. You grant the operator a perpetual licence to display, reformat, copy, excerpt and otherwise use the content submitted by you on this web site and any derivative web site the operator may introduce. You accept sole responsibility for all information publicly posted or privately transmitted by you through the service and that the operator will not be liable for errors, omissions, copyright breaches etc in any content provided by you.

MyGrievance.co.uk Communications

In the course of providing you services, MyGrievance.co.uk may need to communicate with you via email. You agree to receive emails relating to your use of the service.

Monitoring and Enforcement

The operator retains the right to monitor activity and content associated with the service, but is not obliged to do so. The operator makes no commitment to control or actively monitor content. If you are exposed to content that you find objectionable, you can draw it to the operator’s attention. The operator may investigate the complaint and, at its sole discretion, do whatever it deems appropriate, which might include taking no action.

Fees

Signing up for a member account with MyGrievance.co.uk is free. The operator reserves the right to charge for the service in whole or in part, and to modify the pricing of, add to, or discontinue the service in whole or in part without prior notice. At the time of writing the operator has no intention to ever charge for the service.

Governing Law

The Terms and conditions between you and the operator are governed by and construed in accordance with the laws of the United Kingdom.
