Bailli has published the Court of Appeal's decision in the case of Kuzel v Roche Products (see here). The unusual nature of this appeal is described in the judgment. Although the appellant Dr Kuzel did not get what she was seeking from the appeal, the court's decision upholds the principles applied by the Employment Appeal Tribunal, with the added benefit of a particularly clear explanation by Lord Justice Mummery, the essence of which is at paragraphs 48-55 Where an employer has dismissed an employee purportedly for a fair reason, and where the employee contends that the dismissal was for a different, unfair reason, the principles in this case should be considered by both parties
